1. Operator

tofu ("we", "us", "our") is operated by WITHTOFU TECHNOLOGY, a business registered in Malaysia under registration no. 202603210840 (MA0350821-K). You can reach us at hello@withtofu.app.

2. Acceptance of these terms

By creating an account, creating an event, joining an event as a guest, or otherwise using tofu, you agree to these terms. If you do not agree, do not use the service. If you are using tofu on behalf of an organisation, you confirm you are authorised to accept these terms for it.

3. The service

tofu is an event camera. A host creates a time-boxed event; guests join through a short link or QR code and capture a limited number of photos and videos that collect in one shared gallery.

• The camera opens at the event's start time and closes at its end time. After it closes, guests can no longer view or add to the gallery.
• Each guest gets a fixed number of shots, set by the host when the event is created. Videos are capped at 30 seconds and are included on every tier.
• Self-serve events run up to 5,000 guests and up to 7 days. Anything larger, get in touch and we will arrange it.
• Features, limits, and prices may change. Changes apply to events created after the change, never to one you have already paid for.

4. Accounts & guests

Hosts need an account, using email and password or Google sign-in. Guests do not: they join with a display name of their choosing.

• Keep your account credentials to yourself. You are responsible for everything done through your account.
• As a host you are responsible for your event: who you invite, what your guests capture, and telling them their photos and videos are shared with everyone at the event.
• Anyone with the event link can join while the event is live. Share it accordingly.

5. Acceptable use

Do not use tofu to capture, upload, or share content that is unlawful, infringing, hateful, harassing, sexually explicit, or that invades someone's privacy without a lawful basis. Do not attempt to break, overload, or circumvent the limits of the service.

• Guest-entered names and messages are checked automatically before they appear, and content that fails the check is rejected.
• We may remove content, close an event, or suspend an account that breaches these terms, and will do so without notice where the breach is serious.
• To report content, email us at hello@withtofu.app with the event link and what you are reporting.

6. Your content

You keep the rights to the photos and videos you capture. By using tofu you grant us a limited, non-exclusive licence to store, process, and display that content for the purpose of running your event, providing support, and complying with the law. The licence ends when the content is deleted. We do not use your content for advertising or to train AI models.

7. Pricing & payment

Events are paid for once, up front. There is no subscription and no per-user fee.

• The price depends on how many guests you expect, how many shots each guest gets, and how many days the event runs. Events for up to 20 guests with 5 shots each are free.
• Multi-day events are charged at the full tier price for the first day and a reduced rate for each additional day.
• Payment is handled by Stripe. We never see or store your card details.
• Before an event starts you can upgrade it — more guests, more shots, or more days — and pay only the difference. Nothing can be reduced, and once an event has started its capacity and dates are fixed.
• Prices are in Malaysian Ringgit and include any taxes we are required to charge.

8. Refunds

If your plans change before your event starts, email us and we will refund you. Once an event has started we cannot refund it, because the capacity has already been reserved and used. If a payment is refunded or a chargeback is raised, access to the event ends immediately for everyone, including the host, and its media becomes subject to deletion.

9. Media retention

Event media is kept for 30 days after the event ends, then permanently deleted. We keep no backups, so once deleted it cannot be recovered.

• Download the full-resolution set within those 30 days if you want to keep it. That is the host's responsibility, not ours.
• Deleting an event from the dashboard removes its media immediately.
• We are not liable for media lost because it was not downloaded in time.

10. Availability

We aim to keep tofu running reliably, but we do not guarantee uninterrupted service. The service depends on third-party infrastructure and on your device, camera, and network connection, none of which we control. We may take the service down for maintenance, and will avoid doing so during scheduled events where we can.

11. Disclaimers & liability

The service is provided "as is" and "as available", without warranties of any kind to the extent the law allows.

• We are not liable for captures that fail, uploads that do not complete, or media lost through device, browser, or network problems.
• We are not liable for indirect or consequential loss, including lost profits, lost opportunities, or the sentimental value of a moment that was not captured.
• Where liability cannot be excluded, it is capped at the amount you paid us for the event in question. For free events, that amount is zero.
• Nothing in these terms limits liability that cannot lawfully be limited.

12. Suspension & termination

You can stop using tofu at any time and ask us to close your account, which deletes your events and their media. We may suspend or terminate access if you breach these terms, if we are required to by law, or if we discontinue the service, in which case we will give you reasonable notice and time to download your media.

13. Changes to these terms

We may update these terms as the service changes. The date at the top reflects the current version. If a change materially affects you, we will tell you in the app or by email. Continuing to use tofu after a change means you accept the updated terms.

14. Privacy

Our privacy policy explains what personal data we collect, how it is stored, and the rights you have over it. It forms part of these terms.

15. Governing law

These terms are governed by the laws of Malaysia, and any dispute arising from them is subject to the exclusive jurisdiction of the Malaysian courts.
